This is legal because it's assumed that it is something you would watch anyways and that by taping it you are just 'time shifting' the material to a time when you are available to view it.
'Time Shifting' is only legal when it comes to broadcast programming. Its legal to tape 'Clerks' off of your TV, but it's illegal to borrow a friends' tape of Clerks and dub it. It's fucked up, yeah, but thats how it goes.
