Why would they have it as a test otherwise?? Not to mention the much more incriminating blood tests. The real issue here is getting caught while you're high. How can you tell the typical jack ass high schooler from the stoned jack ass high schooler? The trick for the police is to find a reason to force you to undergo one of these tests if all they do is see you in a store playing with the tinfoil. For the most part, the unmistakable odor of marijuana will do the trick. And as a sidenote I am not some bed-wetting liberal with conspiracy theories abounding (I hate when people talk about "those fascists in Washington, man") but please do not say "The police can't do....fill in the blank." The fact of the matter is they can do whatever they choose to do. Then AFTER THE FACT you can attempt to use your day in court to prove a violation of your right to privacy or that you were robbed of the due process required by our Bill of Rights. In other words.....being high in public is the same as walking around sober in public with a bag on you. That is legally speaking. I'm not talking about anything to do with the law enforcement side of the issue, but rather the judicial side of things. If you heard you can walk around high without pot and/or paraphenalia on you, you heard wrong. And from my experiences in South Carolina, I wouldn't roll the dice on it. Keep some visine in the glove compartment along with some cheap cologne, or better yet put an extra t-shirt in the back seat. Resist the urge to hot box your mom's Tercel. And obey the cardinal rule: maintain. Just letting you know you can and most likely would be successfully prosecuted if you're arrested for being high in public. Actually, being high in private as well. Possesion is possession. Not to mention its nine tenths of the law. Be well.
