If the ratings board did indeed review the film and give it an NC-17, it would be at the very least unethical, possibly illegal to release it as unrated, because it has been rated. It's a deliberately false claim.
I might be making you paranoid for no reason. It's also possible that there's been delays in the ratings process and it just hasn't been finished yet. Could just be beaureaucracy.
