Kirby was already dead at that time. The issue was that he allowed Lee to take "full credit" for the creation of characters that Lee created along with Kirby. It's not entirely without merit, but I don't think it was the correct forum.
I also think it's appropriate to believe that while Brodie would probably know the facts of the creation of those characters, he would be unlikely to go into that much detail under those circumstances.
The basic problem is Lee taking the lion's share of the credit for those characters over the last 30 years more than anything specific to that moment, and this just being one small example. Of course, I don't know the exact nature of what Ross said, but I think Kevin's remarks on the MALLRATS commentary seem like plenty enough "punishment" for stating his opinion.
