There's an interview with Miller's lawyer on the front page of Comic Book Resources today (www.cbr.cc) in which it is stated that Miller has committed to neither. He has an idea for the DKR sequel and simply wants to work with Sienkewicz (oh man, I hope that's right) again, Daredevil being the most obvious outlet for that. But no deals have been signed with either DC or Marvel yet.
That said, I wouldn't be surprised to see one or both of these fall through.
