Warner Communications doesn't just own that one script, it owns DC Comics, which in turn owns a slough of comic book characters, including of course Superman, one of its flagship characters.

Now, Warner seems fairly willing to not pursue promoting a gain in sales to the comic version of these characters, happy to leave those to sell what they sell. They do, however, seem quite pleased to own them as potential film characters and play around with various ideas for filming one or the other all the time.

What this boils down to is, without Warner there is no Superman movie. Period. They are too huge and they simply aren't going to sell or lease their film rights to those characters to anyone. That means that unless Warner Brothers decided Kevin should take a new crack at it, he wouldn't ever have the rights to pursue any Superman project - at least not one he could distribute to the public.

He has also said, and I'm inferring from your post here, that he isn't interested in directing an action picture, including Superman. His original suggestion for a director was Robert Rodriguez.
